Would you pay him ?
In march 2005 6 years ago I think it was I had my short box painted. I took it down to the shop ready to be sprayed. Just wipe down and tac off. The price was $1000 labour to paint all the pieces cab fenders box hood gate inner fenders everything inside and out.
It was a weekend job so over 2 or three weeks I cant remember. I paid for all the material up front. He sprayed the cab and box first. Got runs inside the cab but said he would come up to the house in a week and wet sand them out. I gave him $500. Then he painted the rest of the parts. There were also some dry spots on the bottom of the box. Again he said he would fix when the truck was done to bring it down. When I picked the truck up I said the other $500 is taped inside the cab when you come up the money is there. I called him week after week. aways somthing.... never showed I stoped calling. I figured he must have not wanted to risk breaking thru the clear and have to respray the inside of the cab. and forgot about it. I know it was a good deal but he never finished his part of the job. Now 2011 my Dad takes his car to the painter for some touch up work. I get a message on my home phone a couple of days later from him saying I forgot to come back and pay him. WTF ? And sends me a bill for $400 not $500 my dad gave him my home phone number. nice Eh ? So do I pay him ?

I wouldn't... at least not all of it. Did you ever get the runs taken care of? If you had to take of it yourself it was your time and your time is worth $$. If you had some one else do it, it was their time and it was worth $$. Bottom line is you have to complete the job to get paid.

No keep your money. Yes you got a great deal at $1000 but he never finished the job. It's his problem that he's out 500 bucks. You cant call up a customer 6 years later lookin for cash cuz you didnt feel like finishing the work that was agreed on. he realeased the truck to you without full payment and an unfinished paintjob. His loss. Now go spend it on some chrome

The 500 taped in the cab was the motivation to come and finish the job. Call him and tell him he never finished the job. Deal was a deal.

Heck, if he said he would go to your house and take care of the paint flaws then he would have seen the money (did you actually tape 500 bones to your cab?) case closed. Especially after...how many years? As far as I'm concerned the deal is done, over-and-done-with. Was anything else in writing about this agreement?

I had the cash taped where the sun visior would go. Then I took it and bought the 650 Speed Demon.
Nothing in writing on labour just the paint cost. I think he was just going to hide it as a cash job.

I have a business, and I believe every businessman should make every attempt to go above and beyond for every one of their clients. It's a business, and you're in business to make money, but more importantly your integrity and quality of work is what defines your business to others rather than how much you charge. From what I read it sounds like he doesn't have much integrity nor quality of work. Don't pay him. Even if you did have a signed contract with him, don't pay him.
If he really wants the money, he'll take you to court. That will be in your favor because either he'll be court ordered to finish the job to your satisfaction, or he will be court ordered to drop the issue and you keep the money. I'd ignore him and the bill. Judging by his previous behavior he'll most likely figure it's not worth the hassle and fade off your radar again. It'll cost him too much in time and money to pursue the issue and finish the job, either on his own initiative or by court order. Ignore him. |

Well after 27 votes, 100% NO's just about sums it up for ya huh? Hard to believe that this guy would remember missing 500 bucks from 6 years ago. Seems like hes running into money issues and trying to scrape up what he can. If that's the case Im pretty sure I know why business aint been so good.

He must not have needed the money very bad then to not go finish the job when there was 500 cash green bones waiting for him then and there.
I'd say if he wants the money he needs to finish the job but you might expect to have to pay for the extra materials this late in the deal. |

This is common practice in construction, you NEVER pay for the full job until after it's completed. That way you have some leverage if something was done incorrectly or wrong. It's called retainage.
Retainage: In a construction Contract, money earned by a Contractor but not paid to the contractor until the completion of construction or some other agreed-upon date. The amount is held back as assurance for the quality of the work. The idea works well for just about any time you have someone do work for you. You were "right" to have done what you did.

DO NOT PAY HIM! I got suckered...
I made a deal with a guy and regardless of getting a GOOD DEAL or not, if he doesnt do what he said he'd do he shouldnt get paid! He nickel and dimed me and I eventually paid him in full, and he left me hanging....F THAT! Ive learned not to be a nice guy and to get what I paid for. |
