I just got an email back from a Transmission shop owner. He told me the retainer ring missing would not cause the leak.

He did say if your driven gear is old and worn out, fluid could be slipping by on the stem of the driven gear, especially if it has a ring groove where the inner seal rides.

I need to remove mine anyway and install one with 2 extra teeth as I changed my rear gears from 308 to 372 and the speedo reads 5/6 mph to fast on the gauge
