Removal. All items must be removed within 10 business days from the time and date of issuance of the Buyer’s Certificate. Purchases will be released only upon receipt of payment as specified. Successful bidders are responsible for loading and removal and any and all property awarded to them from the place where the property is located as indicated on the website and in the Buyer’s Certificate. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Under no circumstances will Missouri State Agency for Surplus Property assume responsibility for packing, loading or shipping. Removal of property will need to be arranged with Brian Miller.
Default. If after the award, the Buyer breaches the contract by failure to pay for or remove, the Buyer shall lose all right, title and interest which they may otherwise have acquired in and to such property as to which a default has occurred. The bidder agrees that in the event they fail to remove the same within 10 business days, the State shall be entitled to retain (or collect) as liquidated damages per lot, a sum equal to the greater of (a) 20% of purchase price of the item(s) as to which default has occurred or (b) $100.00.
Purchaser's failure to remove items awarded will be cause for removal of bidder from bidders list for future sales.
