I see this a lot on CL, people having a lost title. I just called the Tax office in my county, and here's what they said.
If the seller does not have a copy of the title, they need to have one in hand before the purchase can take place. They have to fill out a form (VTR-34, Application for Certified Copy of Title) and send it in to TxDMV, or take the form and any required documents to a TxDMV Regional Service Center. The person submitting that form must be the owner, lienholder or a verified agent of owner/lienholder. Once they receive the title, the purchase can proceed. Here's the kicker: It may take up to 20 days for the DMV to issue the title. More info here.
